By submitting this application, you: (1) acknowledge that you have reviewed the credit card Terms and Conditions; (2) agree to submit your application for this credit card subject to those Terms and Conditions; and (3) authorize us to use the information in your application, and any other information we or our affiliates have about you, to determine your ability to pay, as required by Federal law.
You have read the accompanying application, and you affirm that everything you have stated is true and complete. You are at least 18 years of age or you are at least 21 years of age if a permanent resident of Puerto Rico. You authorize FIA Card Services, N.A. (hereinafter “us” or “our”) to obtain your credit report(s), employment history and any other information in order to approve or decline this application, service your account, and manage our relationship with you. You consent to our sharing of information about you and your account with the organization, if any, endorsing this credit card program. You authorize us to share with others, to the extent permitted by law, such information and our credit experience with you. In addition, you may as a customer later indicate a preference to exempt your account from some of the information-sharing with other companies (“opt-out”). If you accept or use an account, you do so subject to the terms of this application, the “Details of Rate, Fee and Other Cost Information” and the Credit Card Agreement, as it may be amended; you also agree to pay all charges incurred under such terms. Any changes you make to the terms of this application will have no effect. You understand that your credit line will be determined based on your creditworthiness and your account type will be determined based on your approved credit line as follows: if your application is approved with a credit line of $5,000 or greater, you will receive a World MasterCard®
account; if the credit line is less than $5,000, you will receive a Platinum Plus®
account. The APRs, Annual Fees and benefits for Platinum Plus accounts differ from World MasterCard accounts. You understand that only a portion of your Total Credit Line will be available for Bank Cash Advances. You accept that on a periodic basis your account may be considered for automatic upgrade at our discretion. You consent to and authorize us, any of our affiliates, or our marketing associates to monitor and/or record any of your phone conversations with any of our representatives. If additional development is necessary based on the application information provided, we will make every attempt to contact you.
The following terms are for your Spirit Airlines MasterCard®credit card account.
FIA Card Services, N.A. (also referred to as “we,” “us” or “our”) issues and administers the credit card program and Spirit Airlines manages the Spirit Airlines FREE SPIRIT™ Miles Program. Review and keep this document (“Program Rules”). The Program Rules are separate from the terms of your Credit Card Agreement.
CARDHOLDER MILES AWARDS
Earning Miles: Each Cardholder, joint Cardholder, and authorized user(s), if any, (referred to as “Cardholder(s),” “Participant(s),” “you,” or “your”), with a Spirit Airlines credit card account (a “Card”) may earn and use miles under the FREE SPIRIT Miles Program (“Miles”) which will be deposited into the Primary Cardholder’s FREE SPIRIT account. Miles earnings are based on the new net retail purchase transaction volume (i.e., purchases less credits, returns, and adjustments) charged to the Card during each periodic billing cycle by Participant(s) (“Net Purchases(s)”). World MasterCard® Cardholders will earn two (2) Miles for every dollar of Net Purchases. Platinum Plus® MasterCard Cardholders will earn one (1) Mile for every dollar of Net Purchases. Fractions of Miles equal or greater than .50 are rounded up and less than .50 are rounded down. Please refer to the materials with your Card to identify your Card type.
Your monthly periodic billing cycle statement for the Card (the “Statement”) will report the number of corresponding Miles earned with the Card during the corresponding Billing Cycle. In all instances, Miles are not considered eligible for use until they have appeared on the Statement.
Balance transfers, cash advances, including purchases of cash equivalents of any kind, fees, interest charges, credit insurance, credit protection, or debt cancellation charges and fraudulent transactions do not earn any Miles. We may adjust your Miles for any valid reason including use of the Account for an improper purpose.
There is no limit to the number of Miles you can earn with your Card. No Miles are earned if: Your account is not in good standing (i.e., does not have active charging privileges); or Your Spirit Airlines MasterCard Account is closed by you or by us.
Activation Bonus Miles: World MasterCard Cardholders will receive 15,000 bonus Miles and Platinum Plus Cardholders will receive 5,000 bonus Miles after first use of your account for a Purchase (that is not later returned or rescinded) that is posted in the first 90 days after account opening. These bonus Miles will be awarded at the close of your billing statement after you make your first Purchase.
Anniversary Bonus Miles: If you spend at least $10,000 in Net Purchases on your Card within a year (beginning on the date you open your account and continuing for every 12 month period thereafter) and pay your annual fee, you will be awarded 5,000 bonus Miles. The bonus Miles will be posted to your Miles account within four to six weeks of the anniversary of your Card’s open date.
Redeeming Miles: Miles are not your property and have no cash value. Miles may not be brokered, bartered, attached, pledged, gifted, sold, or unless specifically authorized by us, transferred to anyone else under any circumstances, including but not limited to: disability, death, upon operation of law, or in connection with any domestic relations dispute and/or legal proceeding. We shall have no liability for disagreements between Cardholders regarding Miles. Discrepancies about Miles earnings are not treated as credit card billing disputes: refer to your Credit Card Agreement or the annual Your Billing Rights notice for details about billing disputes. Unless specifically authorized by us, Miles cannot be transferred between any credit card accounts issued by us. You are solely responsible for any tax that might be applicable to your award of Miles from the use of your Account. You may be issued an Internal Revenue Service Form 1099 (or other appropriate form) that reflects the value of such reward. Please consult your tax advisor, as neither Spirit Airlines, FIA Card Services, N.A., its affiliates, nor their employees provide tax advice.

To redeem Miles, you must be an active member of the FREE SPIRIT Miles Program. One way to be an active member is to use your Card each month for at least one purchase. FIA Card Services, N.A. and Spirit Airlines may, from time to time, and in their discretion, modify, combine, extend, suspend or discontinue the Program, including Program benefits, in whole or in part, at any time, even though such actions may affect the accrual and/or value of Miles.

We are not liable or responsible for the failure of Spirit Airlines to award or redeem any Miles. You agree to release FIA Card Services, N.A., Spirit Airlines, and each of their respective affiliates and subsidiaries from all liability for injury, accident, loss, claim, expense or damages sustained by you and anyone traveling with you or without you in connection with the receipt, ownership, or use of Miles. The foregoing entities shall not be liable for consequential damages, and the sole extent of liability, if at all, shall not exceed the actual value of the travel reward obtained from the redemption of the Miles. Alerts received as text messages on your mobile access device may incur a charge from your mobile access service provider. Mobile App alerts are not available on select devices.
Text Banking. Bank of America does not charge for Text Banking. However, your mobile service provider may charge for sending and receiving text messages on your mobile phone. Check with your service provider for details on specific fees and charges that may apply.
Mobile Banking. To access Online or Mobile Banking, you must enroll in the service. Once enrolled, the same Online ID and passcode can be used to access both Online and Mobile Banking. Overdraft transfers to your Bank of America checking account from your credit card account will be Bank Cash Advances under your Credit Card Agreement. Transfers will be subject to the terms of both your Credit Card Agreement and the account agreement(s) and disclosures governing your Bank of America checking account. If you link your Bank of America checking account to your credit card for Overdraft Protection, we will automatically transfer funds in multiples of $100 from your credit card account to cover any overdraft on your checking account, as long as the portion of credit available for cash on your credit card account is sufficient and you are not in default under your Credit Card Agreement. A fee of $10 will apply for each transaction. The fee will not be assessed if your checking account is overdrawn by a total amount less than $10, after we finish processing for the day. The Bank Cash Advance will accrue interest at the APR stated in your Credit Card Agreement. If the portion of credit available for cash on your credit card account is insufficient to cover the amount required by the overdraft (in the multiple of funds stated above), we may advance the funds even if it causes your credit card account to exceed your Cash Credit Line. Linking Overdraft Protection from your Bank of America checking account to your credit card will end any Overdraft Protection connections to your Bank of America savings account. If the total amount you request exceeds your Total Credit Line, we may send full or partial payment to your creditors in the order you provide them to us. Allow at least 2 weeks from account opening for processing. Continue paying each creditor until the transfer appears as a credit. Balance Transfers incur interest charges from the transaction date. If you revolve your balance to take advantage of a promotional or introductory offer, all transactions and balances, including purchases, will be charged interest. The Balance Transfer fee is 3% of the amount of the transaction (min. $10). If you have a dispute with a creditor and pay that balance by transferring it to your new account, you may lose certain dispute rights. Balance Transfers may not be used to pay off or pay down any account issued by FIA Card Services, N.A.
