Bank of America 2006-2007 Financial Aid Sweepstakes Official Rules

No Purchase, Loan or Loan Application Necessary. A purchase, loan or loan application will not increase your chances of winning. Offer expires 8/3/07.
1.Eligibility: This sweepstakes is available only in the United States and is open only to legal residents of the 50 United States, including the District of Columbia, 13 years of age or older who are full-time high school seniors or college students (attending a high school or accredited college or university within the U.S.) any time during the promotion period (defined below). Employees of Bank of America (the Sponsor), its parent, affiliates, subsidiaries, branches and advertising and promotion agencies including Project Support Team Inc. (collectively, the "Released Parties"), and all of their employees' immediate family members (spouses, parents, children, siblings and their respective spouses) and all others with whom they are domiciled, whether or not related, are not eligible to enter or win. Subject to all applicable federal, state and local laws. Void in Puerto Rico and all other US Territories and where prohibited by law. Eligible minors must have their parent's or legal guardian's permission to enter.
2.How to Enter: There are four ways to enter: (1) Visit Sponsor's web site at www.bankofamerica.com/studentsweeps any time from 9:00 AM Pacific Time ("PT") on 8/5/06 through 12 Noon PT on 8/3/07 (the "promotion period"), and complete and submit the online entry form; (2) download and print out or photocopy the online registration form and complete and mail it to: 2006-2007 Financial Aid Sweepstakes, P.O. Box 16064, Bridgeport, CT 06673-6064; (3) request a copy of the registration form (which will be sent to you by mail) by calling the Bank toll-free at 1.800.344.8382 or by sending a business-sized, self-addressed, stamped envelope to: 2006-2007 Financial Aid Sweepstakes Entry Form Request, P.O. Box 13106, Bridgeport, CT 06673-3106 (VT residents may omit return postage). All requests must be received by 7/20/07. When you receive your registration form by mail, complete the form and mail it in the postage-paid business reply envelope provided; or (4) If you receive a Bank of America Borrower Survey by mail, complete and mail the pre-addressed, postage paid survey questionnaire and you will be entered in the sweepstakes. All mailed entries must be received by 8/10/07. There is a limit of one entry per individual for the duration of the promotion period regardless of method of entry used. Entries in excess of one from any individual will be void. The use of automated entry devices of any kind is prohibited and any such entries are void. Released Parties are not responsible for lost, late, incomplete, damaged, mutilated, stolen, misdirected, illegible, inaudible or postage-due entries, entry forms, registration forms, surveys or mail, and all such entries shall be ineligible. Released Parties are also not responsible for incomplete, lost, interrupted or unavailable network, server or other connections, miscommunications, computer or software malfunctions or telephone transmission problems, telephone lines or other telephone problems, technical failures, garbled transmissions, damage to a user's computer equipment (software or hardware) or other errors or malfunctions of any kind whether, human, mechanical, electronic or otherwise or for printing or other errors appearing on the official entry form, registration form or other sweepstakes related materials. Other than as specifically permitted in these rules, downloaded, mechanically or otherwise reproduced entries will not be accepted. All entries will become the property of Sponsor upon submission and will not be acknowledged or returned.
3.Prizes: (5) Grand Prizes: Each winner will receive $1,000 (awarded as a check) which may be used toward college tuition. Total Actual Retail Value ("ARV") of all prizes is $5,000. Odds of winning will depend on the total number of eligible entries received. Prizes are not transferable and no substitution of prizes is allowed, except in the sole discretion of Sponsor. All federal, state and local taxes on prize, if any, and any expenses not specifically included in the prize descriptions herein, are the responsibility of the individual winners. Prizes won by eligible minors will be awarded in the name of the minor's parent or legal guardian.
4. Judging: Winners will be selected in a random drawing conducted by Project Support Team, Inc., an independent judging organization, on or about 9/7/07 from among all eligible entries received. By participating, entrants agree to be bound by these Official Rules and to the decisions of the judges, which will be final and binding in all respects. Winners will be notified by mail and/or telephone on or about 9/21/07. If any potential prize winner cannot be reached within five (5) business days of the first attempted notification, then the prize will be forfeited in its entirety and awarded to an alternate winner. All prizes will be awarded. Winners, or a parent or legal guardian of each winner who is an eligible minor, will be required to complete, sign, and return an Affidavit of Eligibility, Liability Release, IRS Form 1099, and, where lawful, Publicity Release, all of which must be received by Sponsor or its designated agent within 14 days of issuance of notification. If Affidavit and Release form is not returned within the stated time, or is undeliverable, prize will be forfeited in its entirety and awarded to an alternate winner.
5. Miscellaneous: All online entries must include a valid e-mail address. In the event of a dispute as to the identity or eligibility of an online entrant based on email address submitted, entrant will be deemed to be made by the "Authorized Account Holder" of the e-mail address submitted at the time of entry The "Authorized Account Holder" is the person to whom the applicable Internet service provider or other organization (such as business or educational institution) has assigned the e-mail addresses for the domain associated with the submitted e-mail address. Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of this sweepstakes is a violation of criminal and/or civil laws and should such an attempt be made, Sponsor reserves the right to disqualify entrant and seek damages and other remedies to the fullest extent permitted by law. Sponsor reserves the right, in its sole discretion, to void suspect entries or to modify, cancel or suspend the online portion of this sweepstakes should virus, bugs, non-authorized human intervention or any other causes beyond the control of Sponsor corrupt or impair the administration, security, fairness or proper play of the sweepstakes. In any such event, Sponsor will select winners from among all eligible non-suspect online entries received up to the date of cancellation of the promotion and all other eligible entries received for the entire promotion. Sponsor reserves the right to invalidate any and all entries of an entrant which Sponsor, in its sole discretion, determines to be in violation of these Official Rules or any and all entries of an entrant who Sponsor determines has engaged in any act or activity which corrupts or impairs the administration, security, fairness or proper play of this sweepstakes. Entrants (and parents/legal guardians of minor entrants) agree: 1) if a winner, by acceptance of prize, to use of name, voice, biography, likeness and other indicia by Sponsor and its designees in any medium now or hereafter known without further notice, consideration or compensation for marketing, promotion, advertising, filing and dissemination purposes, except where prohibited by law; and 2) to indemnify, defend and hold harmless Released Parties from any and all liability, claims, law suits, costs, expenses, fees, losses, injuries or damages to entrants or any other person or entity, including personal injury, death or damage to personal or real property, arising directly or indirectly from the acceptance, possession, use or misuse of a prize, participation in this sweepstakes and/or from entrant's fraudulent or wrongful acts or omissions. Sponsor shall have the sole right to disqualify any entrants for violation of these rules or any applicable laws relating to the Sweepstakes, and to resolve all disputes in its sole discretion.
6. Winners List: For the names of the winners, send a self-addressed, stamped envelope by 11/2/07 to: Bank of America 2006-2007 Financial Aid Sweepstakes Winners List, P.O. Box 13199, Bridgeport, CT 06673-3199.
